1. ALL SALES FINAL

To protect the integrity of the artwork and the business, all sales are final. We do not accept returns, exchanges, or cancellations due to change of mind.

  • Color Accuracy: We do our best to photograph artwork to represent colors accurately. However, screen resolutions and settings vary. Please be aware that the colors of the physical piece may differ slightly from what you see on your device. This discrepancy is not grounds for a return.

  • Sizing: Please verify the dimensions listed in the product description and measure your space before purchasing.

2. DAMAGES & SHIPPING ISSUES

We pack every piece with extreme care. However, accidents during transit can happen. To protect yourself and TCA, you must follow this strict protocol:

  • Inspection Window: You must inspect your package immediately upon delivery.

  • Reporting Damages: If your item arrives damaged, you must contact us at [Insert Your Email Here] within 48 hours of the delivery timestamp.

  • Required Evidence: Your email must include:

    1. Clear photos of the damaged artwork.

    2. Clear photos of the packaging (box and padding), showing where the damage occurred to the exterior.

  • Resolution: If you do not report damage within the 48-hour window, we cannot file a claim with the carrier, and we cannot offer a refund or replacement.

3. SHIPPING & DELIVERY

  • Transfer of Responsibility: Once the package is handed over to the shipping carrier (UPS, FedEx, USPS, or DHL) and a tracking number is generated, ownership of the item transfers to the buyer. THATCUBANARTIST is not responsible for lost, stolen, or delayed packages once they are in the carrier’s possession.

  • Incorrect Addresses: Please double-check your shipping address at checkout. If a package is returned to us due to an incorrect or incomplete address provided by the buyer, the buyer is responsible for the cost of re-shipping.

4. INTELLECTUAL PROPERTY & COPYRIGHT

Buying the art does not mean you own the image.

  • Copyright Retention: The artist (THATCUBANARTIST) retains all copyright and reproduction rights to all artwork sold.

  • Prohibited Use: You may not reproduce, scan, print, or use the image for any commercial purpose (e.g., merchandise, marketing, resale of prints) without express written permission from the artist.

  • Artist Rights: The artist reserves the right to create and sell prints or reproductions of any original artwork sold.

5. COMMISSIONS & CUSTOM WORK

If you commission a custom piece:
